بيان — الأحكام والشروط

باستخدامك تطبيق بيان («التطبيق») أو الموقع (muathdev.web.app)، فإنك توافق على الالتزام بهذه الأحكام والشروط. يرجى قراءتها بعناية قبل إتمام أي عملية دفع.

١. تعريف الخدمة

بيان منصة إلكترونية تدار من قبل Kodlynx («نحن») تربط المستخدمين بمستشارين قانونيين مرخّصين من مكتب رَسيم للمحاماة في المملكة العربية السعودية. تُقدَّم الاستشارات رقميا عبر:

رسائل نصية داخل التطبيق.
مكالمات صوتية مباشرة بحد أقصى أربعين (٤٠) دقيقة لكل جلسة.

الخدمة رقمية بالكامل؛ لا يتم شحن أي منتج مادي.

٢. الأهلية

يجب أن يكون عمرك ١٨ عاما أو أكثر.
باستخدامك للتطبيق، تُقر بأنك تستوفي هذا الشرط وأن المعلومات التي تقدمها صحيحة.

٣. التزامات المستخدم

تقديم وصف صادق ودقيق لطلب الاستشارة.
عدم إرسال محتوى مسيء أو غير مشروع أو ينتهك حقوق الغير.
عدم استخدام المنصة لأغراض احتيالية أو لغسيل الأموال أو لأي نشاط محظور.
عدم تسجيل المكالمات الصوتية أو مشاركة محتوى الاستشارة بلا إذن من المستشار.
حماية جهازك ومعلوماتك؛ فأنت مسؤول عن الاستخدام الذي يتم من جهازك.

٤. التزامات المستشار

أن يكون مرخّصا قانونيا لتقديم الاستشارات في المملكة العربية السعودية.
الرد على الاستشارة خلال ٢٤ ساعة كحد أقصى من تأكيد الدفع.
المشاركة في المكالمة الصوتية خلال الموعد المحدد.
الحفاظ على سرية معلومات المستخدم وعدم مشاركتها مع الغير.
تقديم استشارة مهنية ضمن نطاق تخصّصه والأنظمة المعمول بها.

٥. الأسعار والدفع

جميع الأسعار تُعرض بـ الريال السعودي (SAR) وتشمل ضريبة القيمة المضافة ورسوم الخدمة إن وجدت.
السعر يظهر للمستخدم بشكل واضح قبل تأكيد الدفع.
تُقبل بطاقات Visa و Mastercard و مدى عبر بوابة دفع إلكتروني مرخّصة.
لا نقوم بتخزين أرقام البطاقات أو بيانات CVV. تتم المعالجة بالكامل لدى مزوّد خدمة الدفع.
يتم التحقق من المبالغ من جهة الخادم لمنع أي تلاعب.

٦. بدء الاستشارة ونهائية الدفع

تُعتبر الاستشارة «قد بدأت» عند إرسال المستشار لأول رد نصي، أو عند انضمامه إلى المكالمة الصوتية.
بعد بدء الاستشارة، يصبح الدفع نهائيا وغير قابل للاسترجاع، وذلك لأن الخدمة رقمية قد أُنجز تقديمها.

٧. المكالمات الصوتية

الحد الأقصى لمدة المكالمة هو ٤٠ دقيقة لكل جلسة. تنتهي الجلسة تلقائيا عند بلوغ هذه المدة.
إذا لم ينضم المستشار إلى المكالمة خلال ٦٠ ثانية من بدء المحاولة، لا يتم خصم المبلغ من المستخدم.
لا يتم تسجيل المكالمات. المكالمات محمية بتشفير نقطة-إلى-نقطة عبر مزوّد الخدمة.
يتطلب إجراء المكالمات إذن الوصول إلى الميكروفون.

٨. إخلاء المسؤولية

المستشار مقدّم خدمة مستقل. بيان منصة وسيطة ولا تتحمل مسؤولية القرارات أو النتائج القانونية المترتبة على الاستشارة.
الاستشارات المقدمة هي توجيه مهني عام ولا تُعدّ بديلا عن التمثيل القانوني الرسمي أمام الجهات القضائية.
لا نضمن توفر المستشارين في جميع الأوقات.
لا نتحمل مسؤولية الأضرار غير المباشرة أو التبعية الناشئة عن انقطاع الخدمة أو الأعطال التقنية.

٩. تعليق أو إنهاء الخدمة

نحتفظ بحق تعليق أو إنهاء الوصول إلى التطبيق لأي مستخدم يخالف هذه الأحكام.
يحق لنا تعديل أو إيقاف أي جزء من الخدمة في أي وقت مع إشعار مسبق حين يكون ذلك ممكنا.

١٠. الملكية الفكرية

جميع حقوق التطبيق وتصميمه ومحتواه محفوظة لشركة Kodlynx. لا يجوز نسخ أو إعادة إنتاج أي جزء منه بدون إذن كتابي مسبق.

١١. القانون الواجب التطبيق

تخضع هذه الأحكام لأنظمة المملكة العربية السعودية.
أي نزاع ينشأ عن استخدام التطبيق يُحال إلى الجهات القضائية المختصة في مدينة مكة المكرمة.

١٢. التعديلات

نحتفظ بحق تعديل هذه الأحكام في أي وقت. سيتم نشر النسخة المحدثة على هذه الصفحة مع تحديث تاريخ «آخر تحديث». استمرارك في استخدام التطبيق بعد التعديل يعني قبولك للأحكام المحدثة.

By using the Bayan mobile application (the "App") or the website (muathdev.web.app), you agree to be bound by these Terms & Conditions. Please read them carefully before completing any payment.

1. Service Definition

Bayan is an electronic platform operated by Kodlynx ("we", "us") that connects users with licensed legal consultants from Raseem law firm in the Kingdom of Saudi Arabia. Consultations are delivered digitally via:

In-app text messages.
Live voice calls, up to a maximum of forty (40) minutes per session.

The service is entirely digital; no physical goods are shipped.

2. Eligibility

You must be 18 years or older.
By using the App, you confirm you meet this requirement and that the information you provide is accurate.

3. User Responsibilities

Provide an honest and accurate description of your consultation request.
Do not send offensive, unlawful, or rights-infringing content.
Do not use the platform for fraudulent purposes, money laundering, or any prohibited activity.
Do not record voice calls or share consultation content without the consultant's consent.
Protect your device and information; you are responsible for activity performed from your device.

4. Consultant Responsibilities

Be legally licensed to provide consultations in the Kingdom of Saudi Arabia.
Respond to the consultation within a maximum of 24 hours from payment confirmation.
Join voice calls at the scheduled time.
Maintain the confidentiality of the user's information and not share it with third parties.
Provide professional consultation within their area of specialization and applicable regulations.

5. Pricing and Payment

All prices are displayed in Saudi Riyals (SAR) and include VAT and service fees, where applicable.
The price is shown clearly to the user before payment confirmation.
Visa, Mastercard, and Mada cards are accepted via a licensed payment gateway.
We do not store card numbers or CVV data. Processing happens entirely with the payment service provider.
Amounts are verified server-side to prevent tampering.

6. Start of Consultation and Finality of Payment

A consultation is deemed "started" when the consultant sends their first text reply, or when they join the voice call.
Once the consultation has started, payment becomes final and non-refundable, as the digital service has been rendered.

7. Voice Calls

The maximum call duration is 40 minutes per session. Sessions end automatically when this limit is reached.
If the consultant does not join the call within 60 seconds of the connection attempt, the user is not charged.
Calls are not recorded. Calls are protected by end-to-end encryption via the service provider.
Making calls requires microphone access permission.

8. Disclaimer

Consultants are independent service providers. Bayan is an intermediary platform and is not responsible for the decisions or legal outcomes resulting from a consultation.
Consultations provided are general professional guidance and do not substitute for formal legal representation before judicial authorities.
We do not guarantee consultant availability at all times.
We are not liable for indirect or consequential damages arising from service interruption or technical failures.

9. Suspension or Termination

We reserve the right to suspend or terminate access for any user who violates these terms.
We may modify or discontinue any part of the service at any time, with prior notice where feasible.

10. Intellectual Property

All rights to the App, its design, and content are reserved to Kodlynx. No part of it may be copied or reproduced without prior written permission.

11. Governing Law

These terms are governed by the laws of the Kingdom of Saudi Arabia.
Any disputes arising from the use of the App shall be referred to the competent judicial authorities in the city of Makkah.

12. Amendments

We reserve the right to amend these terms at any time. The updated version will be published on this page with an updated "Last updated" date. Continued use of the App after amendments constitutes acceptance of the updated terms.
